Rise+ — Privacy Policy & Terms of Use

This page contains both the Privacy Policy and the Terms of Use for Rise+ (“Rise+”, the “App”). Rise+ is operated by APPTOIC (“we”, “us”, “our”). By downloading, accessing, or using Rise+, you agree to both documents below. If you do not agree, please do not use the App.

Part 1 — Privacy Policy

We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains what we collect, why, how we use it, and the rights you have. We aim to comply with the GDPR (EU), KVKK (Türkiye), and Apple’s App Store requirements.

1. Information We Collect

a) Account information

  • When you sign in with Google or Apple, we receive your name, email address, and (if available) profile photo.

b) Plan data

  • The goals, tasks, routines, categories, completion status, and end-of-day reviews you create in the App.

c) AI inputs

  • Text messages, voice commands (processed as transcribed text), and images you send to the AI planning agent — used solely to build or update your plan.

d) Calendar and reminder data

  • Event details needed for two-way synchronization with Google Calendar, Apple Calendar, and Apple Reminders — limited to events Rise+ created or linked.

e) Subscription and payment data

  • Subscriptions are processed by Apple and managed via RevenueCat. We receive your subscription status and plan (monthly/yearly), but we never receive or store your payment card details.

f) Push notification token

  • A device token (via Firebase Cloud Messaging) so we can send you reminder and summary notifications.

Rise+ does not use any advertising or third-party marketing tracking/analytics software.

2. How We Use Your Information

  • To create, update, and display your plan.
  • To provide calendar, reminder, and alarm synchronization.
  • To verify your subscription status and unlock the relevant features.
  • To send you reminder and summary notifications (can be turned off in preferences).
  • To maintain security, prevent abuse, and debug issues.
  • To comply with legal obligations.

3. Legal Bases (GDPR / KVKK)

We process your data based on: performance of a contract (providing the App), your consent (calendar/reminder access and notifications), our legitimate interests (security, improvement), and legal obligations.

4. AI Processing & Third-Party Service Providers

To generate your plan, we send the necessary input data to trusted processors:

  • Google Gemini API — AI-powered plan generation and chat.
  • Google Firebase / Google Cloud (Authentication, Firestore, Cloud Functions, Cloud Messaging) — hosting, database, and backend, hosted on European Union servers.
  • RevenueCat and Apple — subscription and payment management.
  • Apple Inc. — Sign in with Apple, Calendar, Reminders, and AlarmKit integrations.
  • Google — Google Sign-In and Google Calendar sync.

These providers process data only to perform services for us. We do not sell your personal data.

5. Your Content Is Not Used to Train AI Models

We do not use your plan data, messages, voice recordings, or images to train AI models, and we do not share them with other users or customers. Your data is used solely to deliver the features you request.

6. Data Retention & Deletion

  • We retain your account and plan data while your account is active.
  • You can delete individual tasks, goals, and routines in the App at any time.
  • You may permanently delete your account and all associated data at any time from the in-app Profile screen, or by contacting hello@apptoic.com.

7. Data Storage & International Transfers

Your data is stored on Firebase / Google Cloud infrastructure hosted in the European Union, and processed by the providers listed above, which may be located outside your country (including the United States). Where required, transfers are protected by appropriate safeguards (e.g., Standard Contractual Clauses).

8. Your Rights

Depending on your location (GDPR/KVKK), you have the right to access, correct, delete, restrict, or object to the processing of your data, to data portability, and to withdraw consent at any time. To exercise these rights, contact hello@apptoic.com. You also have the right to lodge a complaint with your local data protection authority.

9. Children

Rise+ is not directed to children under 13 (or the minimum age required in your country). We do not knowingly collect data from children. If you believe a child has provided us data, contact us and we will delete it.

10. Security

We use industry-standard measures (encryption in transit and at rest, access controls, secure authentication) to protect your data. No method of transmission or storage is 100% secure, but we work to protect your information.

11. Changes to This Policy

We may update this Privacy Policy. Material changes will be reflected by updating the “Last updated” date and, where appropriate, notifying you in the App.

Part 2 — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Rise+. By using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) and able to form a binding contract to use Rise+.

2. Description of Service

Rise+ is a mobile app that turns your goals into concrete daily and weekly schedules through an AI-powered personal planning agent, with task and routine management, calendar/reminder synchronization, voice/photo-based plan creation, and end-of-day review.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Rise+ for your personal, lawful use, subject to these Terms. You may not copy, modify, reverse-engineer, resell, or exploit the App except as permitted by law.

4. Acceptable Use

You agree not to use Rise+ to:

  • Violate any applicable law or the rights of others.
  • Attempt to gain unauthorized access to another user’s account.
  • Disrupt, overload, reverse-engineer, or scrape the App or its systems.
  • Use the App for any purpose other than personal time management.

We may suspend or terminate accounts that violate these rules.

5. Nature of AI Output

Plans, suggestions, and reviews produced by Rise+’s AI agent are provided as suggestions to assist personal time management only; they do not constitute medical, legal, financial, or other professional advice. Please consult a qualified professional for important decisions. AI output may be inaccurate or unexpected — you are responsible for reviewing it before relying on it.

6. Subscriptions & Payments

  • Rise+ offers limited free usage (your first AI-generated goal plan is free) and an optional Rise+ Premium subscription, sold through the Apple App Store.
  • Auto-renewal: subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
  • Manage or cancel your subscription anytime in your Apple ID account settings.
  • We never have access to or store your payment card details — these remain solely between you and Apple.
  • Refunds for App Store purchases are handled by Apple in accordance with Apple’s policies; we do not process refunds directly.
  • Prices may change; changes apply to future billing periods.

7. Intellectual Property

Rise+, its software, design, branding, and content are owned by us or our licensors and are protected by law. These Terms do not grant you any rights to our trademarks or branding.

8. Third-Party Services

The App relies on third-party services (Apple, Google/Firebase, Google Gemini, RevenueCat). Your use of those services may be subject to their own terms. We are not responsible for third-party services.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the App (including missed reminders or synchronization delays). Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using Rise+ and delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms or for legal or security reasons. Sections that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of İstanbul, unless mandatory consumer-protection law provides otherwise.

13. Changes to These Terms

We may update these Terms. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
